1. Acceptance of Terms

By accessing or using www.else.co/canada (the "Site"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree you must discontinue use immediately. elseco Canada Inc. reserves the right to modify these Terms at any time. Continued use after any modification constitutes acceptance.

These Terms apply specifically to the Canadian risk page of the Site, being the page(s) of the elseco Group's website relating to elseco Canada Inc.'s Canadian brokerage and underwriting operations. To the extent these Terms conflict with any general disclaimer or terms published elsewhere on the elseco Group's website, these Terms, together with the governing law and jurisdiction set out in Section 12, shall prevail in respect of the Canadian risk page.

2. Who We Are

elseco Canada Inc. is a Managing General Agent (MGA) licensed with the Registered Insurance Brokers of Ontario. The Site is intended for use by licensed insurance brokers and carrier partners. It is not a consumer-facing portal.

3. Authority to Use the Site

By using the Site, you represent that you have the authority to act on behalf of, and to bind, the brokerage, carrier partner or other organization for which you are accessing the Site to these Terms.

4. Use of the Site

4.1 Permitted Use

  • Access information about elseco's underwriting products and binding authorities

  • Contact elseco's underwriting and compliance team

  • Access compliance documentation and regulatory disclosures

  • Submit risks or access policy documents where portal access has been granted in writing

4.2 Prohibited Use

  • Circumvent any security measure or access control

  • Transmit malicious code, viruses, spam, or unauthorized automated queries

  • Reproduce or commercially exploit proprietary content without written consent

  • Misrepresent your identity, licensing status, or authority

  • Conduct any activity that violates applicable law or regulation

5. No Insurance Advice

Content on this Site is for informational purposes only and does not constitute insurance advice, a binding offer of coverage, or a contract of insurance. Coverage is only bound through a formal binding authority agreement and a signed binder or certificate of insurance issued by elseco in writing.

6. Intellectual Property

All content on the Site is the property of elseco Canada Inc. or its licensors and is protected by Canadian intellectual property laws. Nothing on the Site grants any licence to use our intellectual property without our express prior written consent.

7. Accuracy of Information

Underwriting appetites, binding authority terms, and regulatory requirements change frequently. Always confirm current terms with our underwriting team before relying on Site content for a specific submission.

8. Limitation of Liability

To the maximum extent permitted by law, elseco Canada Inc. shall not be liable for any loss or damage including without limitation, indirect, incidental, special, or consequential damages whatsoever arising from or in connection with, use of the Site.

9. Electronic Communications

By using the Site, you consent to receive communications from elseco electronically, including by email and through the Site, and you agree that an electronic submission, notice or agreement made through the Site satisfies any legal requirement that such communication be in writing, to the extent permitted by the Electronic Commerce Act, 2000 (Ontario) and other applicable law.

We will acknowledge complaints within 5 business days and respond within 30 days.

12. Governing Law

These Terms are governed by the laws of Ontario and federal laws of Canada. Any dispute shall be subject to the exclusive jurisdiction of the courts of Toronto, Ontario.

13. General Provisions

13.1 Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and elseco Canada Inc. regarding your use of the Site, and supersede any prior agreements or understandings relating to the Site.

13.3 Third-Party Links

The Site may contain links to third-party websites, including regulators and industry bodies. elseco is not responsible for the content, accuracy, or practices of any linked third-party site.
