1. About This Policy

elseco Canada Inc. ("elseco", "we", "us", or "our") is a Managing General Agent (MGA) that underwrites insurance under delegated authority on behalf of authorized carrier partners and serving licensed retail brokers across Canada.

This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with our underwriting operations, broker relationships, and regulatory obligations under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

This Policy applies to retail brokers, insured clients, employees, directors, and officers whose personal information we collect or process. By transacting business with elseco you agree to the collection and use of information in accordance with this Policy.

3. Information We Collect

3.1 Broker and Producer Information

  • Full name, brokerage name, and contact details

  • Provincial licence numbers, licence class, and regulator

  • Errors and Omissions insurance details and certificate of insurance

  • Binding authority credentials and submission records

  • Correspondence and underwriting communications

3.2 Insured Information

  • Name, address, and contact information

  • Information relevant to the risk being underwritten

  • Loss history and risk characteristics

We collect only the minimum information necessary to evaluate and bind the risk.

3.3 Employee and Officer Information

We collect personal information about our employees, directors, officers, and contractors as required for employment, licensing, and regulatory purposes.

4. How We Use Your Information

  • Evaluating and binding insurance risks under our binding authority agreements

  • Administering policies and supporting claims handling on behalf of carriers

  • Verifying broker licences and maintaining our broker register

  • Meeting regulatory obligations including RIBO registration and trust reporting

  • Communicating with brokers regarding submissions, renewals, and compliance matters

  • Detecting and preventing fraud and financial crime

  • Responding to regulatory inquiries, carrier audits, and legal proceedings

We do not sell, rent, or trade personal information to any third party for their commercial purposes.

5. Sharing and Disclosure

  • Carrier partners: required to administer binding authority agreements

  • Retail brokers: for policy servicing and client communications

  • RIBO and provincial regulators: as required by law

  • Service providers: bound by confidentiality obligations

  • elseco Group affiliates: for group-wide compliance, audit, information-technology and shared-service functions

Some of the parties listed above are located, or may process or store personal information, outside Canada, including within the elseco Group's operations namely in the United Arab Emirates (DIFC), the United Kingdom, the United States and Singapore. Personal information transferred in this way may become subject to the laws of the jurisdiction in which it is held, including lawful access requests by courts, law enforcement or regulatory authorities of that jurisdiction. elseco requires that any such transfer be subject to contractual or equivalent safeguards consistent with this Policy.

6. Data Retention

  • Policy and underwriting records: 7 years from policy expiry

  • Claims records: 7 years from final settlement

  • Broker records: 7 years from termination of relationship

Retention periods comply with RIBO requirements and applicable provincial insurance legislation.

7. Data Security

  • Access to personal information is restricted on a need-to-know basis

  • Electronic records are stored with password protection and access controls

  • Physical records are stored securely and disposed of by secure shredding

8. Your Rights

You have the right to access, correct, or request deletion of your personal information, subject to legal retention requirements. Contact our Privacy and Complaints Officer to exercise these rights. We will respond within 30 days.

9. Complaints

If you are dissatisfied with how we have handled your personal information, contact our Privacy and Complaints Officer. We will acknowledge your complaint within 5 business days and respond within 30 days.
